A two-day training on the topic „Disciplinary Procedure and Practice“ was held for members of disciplinary commissions

The EU4Justice project, funded by the European Union, in cooperation with the High Judicial and Prosecutorial Council of Bosnia and Herzegovina (HJPC BiH), organized a two-day training titled “Disciplinary Procedure and Practice” on 13 and 14 October, intended for new and current members of disciplinary commissions within the judiciary of Bosnia and Herzegovina.
The training focused on the challenges and lessons learned from recent disciplinary practice and legislative developments, with the aim of strengthening integrity, professionalism, and consistent application of disciplinary standards in the work of judges and prosecutors. The first day of the training began with an introductory session on the work of disciplinary commissions, during which participants were introduced to the legal framework, working methods, ethical standards, and common challenges faced by the commissions in practice.
Sanela Gorušanović - Butigan, Vice President of the HJPC BiH and Bojana Jolović, a member of the HJPC, spoke about recent disciplinary proceedings against judges and prosecutors. In their presentations, they analyzed cases from May 2024 to October 2025 and discussed key legal issues arising from disciplinary cases.
A special segment of the program was dedicated to developing skills for drafting disciplinary decisions and to new provisions of the HJPC Law regarding disciplinary offences. These topics were presented by Vesna Trifunović, Judge of the Court of Bosnia and Herzegovina and Drženko Lugonja, Judge of the District Court in Bijeljina.
The first day concluded with a presentation by Prof. Dr. Lorena Bachmaier Winter, international expert of the EU4Justice project and Professor of Criminal and Civil Procedural Law at the Complutense University in Madrid, who provided an overview of disciplinary practice and challenges from the perspective of international standards.
During the second day, participants discussed the policy of imposing disciplinary measures in the practice of HJPC BiH disciplinary commissions, with a particular focus on the implementation of the Guidelines for Imposing Disciplinary Measures, proportionality of sanctions, and practical examples. Presentations on these topics were delivered by Zlatko Kulenović, Judge of the Constitutional Court of Republika Srpska, and Svetlana Marić, Judge of the Supreme Court of Republika Srpska.
Prof. Dr. Lorena Bachmaier Winter also reflected on the policy of imposing disciplinary measures from the perspective of international standards. The training concluded with a discussion on overall disciplinary policy, including proposals and recommendations by domestic and international experts for the further development of this area.
The proposals and recommendations formulated during the training will serve as a basis for enhancing consistency, transparency, and quality in disciplinary proceedings, thereby further strengthening accountability and integrity within the judiciary of Bosnia and Herzegovina.
